By accessing or using LaunchKiwi (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms apply to all visitors, submitters, and listing owners.
2. Description of Service
LaunchKiwi is a weekly directory of software products, SaaS tools, and indie launches. We allow founders and makers to submit their products for discovery. Listings may be upvoted and reviewed by the community. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
3. Submitting a Product
When you submit a product, you represent and warrant that:
- You own or have the right to list the product
- All information you provide is accurate and not misleading
- The product is a genuine, working software tool or service
- The product does not infringe any third-party intellectual property rights
- The product does not violate any applicable law
We review all submissions and may reject, remove, or modify any listing at our sole discretion — for example, if it is spam, duplicated, inactive, or violates these terms. Submission does not guarantee inclusion.
4. Prohibited Content and Conduct
You may not submit or use the Service to promote products or content that:
- Is fraudulent, deceptive, or misleading
- Contains malware, spyware, or harmful code
- Facilitates illegal activity
- Infringes copyright, trademark, or other intellectual property rights
- Is hateful, harassing, or discriminatory
- Is adult-only content or not suitable for a general audience
You also may not attempt to manipulate votes, scrape the site in bad faith, interfere with site operations, or circumvent any security or access controls.
5. Intellectual Property
You retain all intellectual property rights in your product, name, logo, and description. By submitting content to LaunchKiwi, you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute that content as part of operating the Service (for example, showing your logo and description in the directory).
The LaunchKiwi name, logo, design, and original content on the site are owned by LaunchKiwi and may not be reproduced without written permission.
6. Votes and Community Features
Upvoting and community interactions on LaunchKiwi are intended to reflect genuine user sentiment. Automated voting, coordinated manipulation, or any attempt to artificially inflate or deflate vote counts is prohibited and may result in removal of the associated listing.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We make no endorsement or representation about any listed product.
8. Limitation of Liability
To the maximum extent permitted by law, LaunchKiwi and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability for any claim arising from these terms will not exceed £100.
9. Indemnification
You agree to indemnify, defend, and hold harmless LaunchKiwi and its operators from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the Service, your submitted content, or your breach of these terms.
10. Termination
We may terminate or suspend your access to the Service, or remove any listing, at any time and without notice, for any reason including breach of these terms. You may request removal of your listing at any time by emailing [email protected].
11. Governing Law
These terms are governed by and construed in accordance with applicable law. Any disputes arising under these terms will be resolved through good-faith negotiation in the first instance. If you have a concern, please reach out to us before taking any formal action.
12. Changes to These Terms
We may update these Terms of Service from time to time. We'll notify registered submitters of material changes by email. The "Last updated" date at the top reflects the most recent revision. Continued use after changes constitutes acceptance of the new terms.
